Duty Of Care

The Environmental Protection Act (1990) imposes a Duty of Care on the handling of waste.

The Requirements

Duty of Care affects anyone who:

  • Produces
  • Imports
  • Stores
  • Transports
  • Treats
  • Recycles or
  • Disposes of controlled waste

The primary responsibility for the handling of waste is on the waste producer.
They must ensure that wastes are:

  • Stored securely
  • Transferred to an "authorised" person only
  • Covered by an appropriate Transfer Note
  • Disposed of properly
