Duty Of Care
The Environmental Protection Act (1990) imposes a Duty of Care on the handling of waste.
Duty of Care affects anyone who:
- Recycles or
- Disposes of controlled waste
The primary responsibility for the handling of waste is on the waste producer.
They must ensure that wastes are:
- Stored securely
- Transferred to an "authorised" person only
- Covered by an appropriate Transfer Note
- Disposed of properly
